Terms of Service

Effective date: February 14, 2026

These Terms of Service ("Terms") govern your access to and use of SpriteCook at spritecook.ai ("Service"). By using the Service, you agree to these Terms.

1. Service Description

SpriteCook provides AI-assisted generation and management of pixel art assets through a web application, a public REST API, and AI agent integrations (including MCP-compatible tools for code editors). We use third‑party model providers behind the scenes, including OpenAI, Google Gemini, and xAI. Model selection may change without notice.

2. Eligibility

You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

3. Accounts and Security

You are responsible for all activity under your account and for maintaining the security of your credentials. Notify us promptly of any suspected unauthorized use.

4. API Access and Keys

  • API keys are issued per account and grant programmatic access to the Service. You are responsible for all activity performed with your API keys.
  • Keep your API keys confidential. Do not share them publicly, commit them to version control, or embed them in client-side code.
  • API keys are tied to your account and consume credits from the same balance as the web application.
  • We may revoke API keys at any time if we detect misuse, a security breach, or a violation of these Terms.
  • API access is subject to rate limits and concurrency limits that may vary by subscription tier. We may adjust these limits at any time.

5. Your Content

  • You retain ownership of prompts, references, and uploads you submit ("User Content").
  • You grant SpriteCook a worldwide, non‑exclusive license to process and store User Content to provide and improve the Service.
  • You represent that you have all rights necessary to submit User Content and that it does not violate applicable law or third‑party rights.

6. Generated Outputs

  • Subject to these Terms and applicable law, you may use, reproduce, and distribute outputs you generate.
  • Outputs may not be unique and may be similar to outputs generated by others.
  • You are solely responsible for evaluating outputs for accuracy, suitability, originality, and potential infringement before use.

7. Acceptable Use

  • No illegal, harmful, or infringing content or activity.
  • No attempts to extract training data or misuse model responses.
  • No circumvention of usage limits, rate limits, or access controls.
  • No creating multiple accounts or API keys to circumvent rate limits.
  • No reselling or sublicensing API access to third parties without written permission.
  • No automated scraping, crawling, or bulk downloading of generated assets beyond normal API usage.

8. Third‑Party Providers

The Service relies on third‑party AI model APIs (including OpenAI, Google Gemini, and xAI) and infrastructure vendors. Your use of the Service is also subject to those providers' policies, which may change. We do not control and are not responsible for third‑party services.

9. Credits, Billing, and Trials

Some features require credits or a paid plan. Fees are non‑refundable except where required by law. We may modify pricing or credit allocations with notice for future billing periods. API calls consume credits from the same balance as the web application. Credit costs may vary by generation parameters such as image size, model, and resolution.

10. Privacy

We process limited personal data to operate the Service. We may use anonymized and aggregated data to improve quality and safety. See our Privacy Notice if provided separately.

11. Disclaimers

THE SERVICE AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON‑INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT OUTPUTS WILL BE UNIQUE, ERROR‑FREE, OR MEET YOUR REQUIREMENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPRITECOOK AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE OR OUTPUTS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS IN THE AGGREGATE WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO SPRITECOOK IN THE 3 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR $100, WHICHEVER IS GREATER.

13. Indemnification

You will defend, indemnify, and hold SpriteCook harmless from claims arising out of your use of the Service, your User Content, or your violation of these Terms.

14. Suspension and Termination

We may suspend or terminate access for any violation of these Terms, misuse, or to comply with law. Upon termination, your right to use the Service ceases immediately.

15. Changes to the Service and Terms

We may update the Service and these Terms at any time. Changes become effective when posted. Your continued use constitutes acceptance.

16. Governing Law; Dispute Resolution

These Terms are governed by the laws of the jurisdiction we designate in our contact details, without regard to conflict of laws principles. Disputes will be resolved in that jurisdiction's courts, unless otherwise required by law.
